Diese Bestätigung ist notwendig, damit sich niemand mit fremden E-Mail-Adressen anmelden kann. Die Anmeldungen zum Newsletter werden protokolliert, um den Anmeldeprozess entsprechend den rechtlichen Anforderungen nachweisen zu können. Hierzu gehört die Speicherung des Anmelde- und des Bestätigungszeitpunkts und der IP-Adresse. Ebenso werden die Änderungen Ihrer bei dem Versanddienstleister gespeicherten Daten protokolliert.

Anmeldedaten

Um sich für den Newsletter anzumelden, reicht es aus, wenn Sie Ihre E-Mailadresse angeben. Optional bitten wir Sie, einen Namen zwecks persönlicher Ansprache im Newsletters anzugeben.

Rechtsgrundlage

Deutschland: Der Versand des Newsletters und die mit ihm verbundene Erfolgsmessung erfolgt auf Grundlage einer Einwilligung der Empfänger gem. Art. 6 Abs. 1 lit. a, Art. 7 DSGVO i.V.m § 7 Abs. 2 Nr. 3 UWG bzw. auf Grundlage der gesetzlichen Erlaubnis gem. § 7 Abs. 3 UWG. Österreich: Der Versand des Newsletters und die mit ihm verbundene Erfolgsmessung erfolgt auf Grundlage einer Einwilligung der Empfänger gem. Art. 6 Abs. 1 lit. a, Art. 7 DSGVO i.V.m § 107 Abs. 2 TKG bzw. auf Grundlage der gesetzlichen Erlaubnis gem. § 107 Abs. 2 u. 3 TKG. Die Protokollierung des Anmeldeverfahrens erfolgt auf Grundlage unserer berechtigten Interessen gem. Art. 6 Abs. 1 lit. f DSGVO. Unser Interesse richtet sich auf den Einsatz eines nutzerfreundlichen sowie sicheren Newsletter-Systems, das sowohl unseren geschäftlichen Interessen dient als auch den Erwartungen der Nutzer entspricht und uns ferner den Nachweis von Einwilligungen erlaubt.

Kündigung / Widerruf

Sie können den Empfang unseres Newsletters jederzeit kündigen, d.h. Ihre Einwilligungen widerrufen. Einen Link zur Kündigung des Newsletters finden Sie am Ende eines jeden Newsletters. Wir können die ausgetragenen E-Mail-Adressen bis zu drei Jahre auf Grundlage unserer berechtigten Interessen speichern, bevor wir sie löschen, um eine ehemals gegebene Einwilligung nachweisen zu können. Die Verarbeitung dieser Daten wird auf den Zweck einer möglichen Abwehr von Ansprüchen beschränkt. Ein individueller Löschungsantrag ist jederzeit möglich, sofern zugleich das ehemalige Bestehen einer Einwilligung bestätigt wird.

MailChimp

Für den Versand unserer Newsletter nutzen wir die Dienste von MailChimp. Anbieter ist die Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA. MailChimp ist ein Dienst, mit dem u.a. der Versand von Newslettern organisiert und analysiert werden kann. Wenn Sie Daten zum Zwecke des Newsletter-Bezugs eingeben (z.B. E-Mail-Adresse), werden diese auf den Servern von MailChimp in den USA gespeichert.

MailChimp-Analyse

Mit Hilfe von MailChimp können wir unsere Newsletter-Kampagnen analysieren. Wenn Sie eine mit MailChimp versandte E-Mail öffnen, verbindet sich eine in der E-Mail enthaltene Datei (sog. Web-Beacon) mit den Servern von MailChimp in den USA. So kann festgestellt werden, ob eine Newsletter-Nachricht geöffnet und welche Links ggf. angeklickt wurden. Ausserdem werden technische Informationen erfasst (z.B. Zeitpunkt des Abrufs, IP-Adresse, Browsertyp und Betriebssystem). Diese Informationen können nicht dem jeweiligen Newsletter-Empfänger zugeordnet werden. Sie dienen ausschliesslich der statistischen Analyse von Newsletter-Kampagnen. Die Ergebnisse dieser Analysen können genutzt werden, um künftige Newsletter besser an die Interessen der Empfänger anzupassen.

EU-US-Privacy-Shield

MailChimp verfügt über eine Zertifizierung nach dem «EU-US-Privacy Shield». Der «Privacy-Shield» ist ein Übereinkommen zwischen der Europäischen Union (EU) und den USA, das die Einhaltung europäischer Datenschutzstandards in den USA gewährleisten soll.

Abschluss eines Data-Processing-Agreements

Wir haben ein sog. «Data-Processing-Agreement» mit MailChimp abgeschlossen, in dem wir MailChimp verpflichten, die Daten unserer Kunden zu schützen und sie nicht an Dritte weiterzugeben. Dieser Vertrag kann eingesehen werden.

Widerspruch gegen Datenerfassung

Wenn Sie keine Analyse durch MailChimp wollen, müssen Sie den Newsletter abbestellen. Hierfür stellen wir in jeder Newsletter-Nachricht einen entsprechenden Link zur Verfügung. Des Weiteren können Sie den Newsletter auch direkt auf der Webseite abbestellen.

Rechtsgrundlage

Die Datenverarbeitung erfolgt auf Grundlage Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). Sie können diese Einwilligung jederzeit widerrufen, indem Sie den Newsletter abbestellen. Die Rechtmässigkeit der bereits erfolgten Datenverarbeitungsvorgänge bleibt vom Widerruf unberührt. Die von Ihnen zum Zwecke des Newsletter-Bezugs bei uns hinterlegten Daten werden von uns bis zu Ihrer Austragung aus dem Newsletter gespeichert und nach der Abbestellung des Newsletters sowohl von unseren Servern als auch von den Servern von MailChimp gelöscht. Daten, die zu anderen Zwecken bei uns gespeichert wurden (z.B. E-Mail-Adressen für den Mitgliederbereich) bleiben hiervon unberührt.
